Digital Millennium Copyright Act (DMCA) Notice

In accordance with the Digital Millennium Copyright Act ("DMCA"), LastPass has adopted the following procedure for copyright owners who believe their copyrighted work(s) has been used without permission through LastPass websites or Services. Copyright owners may submit notifications of claimed infringement to LastPass's designated DMCA Agent as described below.

LastPass has designated an agent ("DMCA Agent") to receive and respond to written notifications of claimed copyright infringement. Upon receiving a notification that complies with the DMCA, LastPass will review the notice and take action as appropriate under the circumstances and applicable law. Such action may include contacting the relevant LastPass account holder, removing or disabling access to the infringing material where LastPass has the technical ability to do so, and/or terminating LastPass accounts repeatedly infringe third-party copyrights rights.

LastPass maintains and enforces copyright compliance policies, including processes for addressing and terminating accounts for repeat infringements, where appropriate.

Important notice regarding the LastPass VPN Service: LastPass VPN functions as a provider of transitory digital network communications. It transmits encrypted internet traffic without hosting, storing, or controlling its content. As a result, LastPass VPN cannot remove or disable access to allegedly infringing content in the way a hosting service would.

Additionally, neither LastPass nor its infrastructure provider maintains logs of VPN user browsing activity, traffic history, or connection history. This means LastPass does not have the ability to identify an individual user based solely on the VPN exit IP address. Where a valid notice can be linked to a specific account, LastPass will take appropriate action.

All infringement notifications must be submitted in writing to LastPass’ DMCA Agent at the postal address and/or email above listed, and must include the following: (1) identification of the copyrighted work(s) claimed to be infringed; (2) identification of the material claimed to be infringing, link to the allegedly hosted the infringing content, and information reasonably sufficient to permit LastPass to locate the material; (3) the copyright owner's contact information (including mailing address, telephone number, and email address); (4) the following statements: (i) "I hereby state that I have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law," and (ii) "I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner or am authorized to act on behalf of the owner of the copyright that is allegedly infringed;" and (5) the full name and electronic or physical signature of the copyright owner or the copyright owner's agent.
